したがって「内容虚偽の雇用契約書」を提出した事実は、不法就労とはなんら関係のないものです。

彼等が不法就労者になったのは、

「起訴状」に記載の「訴因」（犯罪の理由）は、入管法２２の４条の４「在留資格取消」の事実を記載しており、

そうであれば、刑法よりも入管法が適用されるのが、法の論理です。

次に、刑法の「幇助罪」適用の因果関係として、

「内容虚偽の雇用契約書」の提供が、在留資格の取得を容易にしたと言いますが、不当です。

在留資格を容易に取得させたというが、在留資格の付与条件は法律で規定されておらず、

付与条件は未公開で、法務大臣が裁量で付与するものであり、

在留資格を容易にしたとは言えません。

仮に、「内容虚偽の雇用契約書」で在留資格を得たとしても、

入管法２２の４条の４「在留資格取消」で規定するとおり、不法就労とは別個のものです。

「起訴状」に記載の「訴因」（犯罪の理由）は、

入管法２２の４条の４「在留資格取消」の事実を記載しており、

そうであれば、刑法よりも入管法が適用されるのが、法の論理です。

検察官は、特別法よりも一般法を優先しています。

入管法は国際法および日本国憲法に従い、

不法就労させた者と不法就労させられた外国人を平等に処罰する法体系になっているのです。

北朝鮮による日本人の拉致監禁が犯罪ならば、日本の拉致監禁も犯罪です。

不法な「拉致・監禁」に「良い」とか「悪い」はありません。

世界は、法の下で、平等に処分されるべきです。
